If you respect of the hotspots on the permit (scroll ed abit on this page http://www.fs.fed.us/r5/inyo/recreation/wild/bear.shtml ) one can hike this section of the JMT legally with an ursack and the use of backcountry bear boxes. The ranger I spoke to said that that is the whole point of their work. Some boxes in SEKI are even designated JMT/PCT through hikers only specifically for this purpose. The biggest problem is getting out of Red's Meadow beyond Virginia Lake on day 1.

The way my permit reads from the Inyo NF we CAN use an URSACK until we get to SEKI. It is only the ten or so days in SEKI that we have to worry about and there are a lot of bear boxes there. Now is just a matter of getting very familiar with where the boxes are and planning around that. And I've got a few months to figure that out. The alternative costs about a pound for no added benefit.
